CONTEST RULES

Rediscover Local Businesses (the "Contest")

November 9 at 12:01 a.m. (EDT) to November 23, 2020 at 11:59 p.m. (EDT) (the "Contest Period")

Organized by PME MTL Centre-Ville, PME MTL Centre-Est, PME MTL Grand Sud-Ouest, PME MTL Ouest-de-l'Île PME MTL Centre-Ouest, PME MTL Est-de-l'ile ("PME MTL")

1. ENTRY MODES

No purchase necessary. This contest is reserved for residents of the Greater Montréal Area and is governed by the laws of Québec.

"Gourmet Box" Entry Mode

To be eligible for the contest, entrants must:

  1. Have a public Facebook account
  2. Visit PME MTL's Facebook page as of November 9 and spot the post
  3. Define their style and preference by commenting "Gourmet".
  4. Pick their favourite Montréal business via a post, to help promote the business among all Montréalers
  5. Be available on December 3rd at 1pm to participate in the virtual event
  6. Post everything as a comment on the Facebook page of the PME MTL contest.

"Experiential Box" Entry Mode 

To be eligible for the contest, entrants must:

  1. Have a public Facebook account
  2. Visit PME MTL's Facebook page as of November 9 and spot the post
  3. Define their style and preference by commenting "Experiential".
  4. Pick their favourite Montréal business via a post, to help promote the business among all Montréalers
  5. Post everything as a comment on the Facebook page of the PME MTL contest.

Submission of a Contest entry means that you have read the Contest Rules and agree to abide by them. You agree that by submitting an entry to the Contest through Facebook, you are providing an electronic signature that binds you to these Contest Rules. Any person entering the contest organized by PME MTL shall unconditionally accept the Contest Rules.

To be valid, entries must be received no later than November 23, 2020 at 11:59 p.m. Eastern Daylight Time (EDT). Limit of one entry per person during the Contest Period regardless of the Facebook or Instagram account selected to enter the Contest. Any person who enters or attempts to enter more than the permitted number of times, or who uses any robotic, automatic, mechanical, electronic or other duplication method not authorized under these rules, will be deemed to have attempted tampering or manipulation, which will automatically void that person's entry, vote or all other results of such entry. No entry will be accepted after the above deadline for any reason. Entries received after this deadline will be rejected.

Your Entry

Your entry includes any content to which you contribute, post (text, photo, drawing, etc.), hashtag or other submitted as part of the Contest.

You represent and warrant to PME MTL that you have all necessary rights and permissions with respect to the Content that you submit to PME MTL. You must have the consent of any identifiable person appearing in your entry (including parental consent for any minor), and must have the necessary authorizations to grant PME MTL the licence specified below.

No person shall publish content belonging to any of the following categories:

(a) Offensive and liable to expose an individual or group of individuals to hatred or contempt based on race, national or ethnic origin, colour, religion, gender, sexual orientation, age or mental or physical disability;

(b) Pornographic, vulgar, obscene or sexually explicit;

(c) Illegal material;

(d) Hate speech;

(e) Threats or harassment;

(f) Threat or incitement to commit an indictable offence;

(g) Profane, defamatory, threatening, insulting or encouraging any activity that may be illegal, inappropriate, risky, dangerous, or socially irresponsible;

(h) Attempts to mobilize the population for any cause other than an PME MTL event;

(i) Where the Contest is hosted on social media platforms, anything that does not comply with the terms of use and rules of these social media platforms;

(j) Infringement of the personal or proprietary rights of any person, entity or organization, including, but not limited to, intellectual property rights. Specifically, your participation may be deemed inadmissible (at the sole discretion of PME MTL) if it contains third party copyrights, trademarks or logos;

(k) Violates any law in Canada and/or;

(l) Defamatory, denatured or derogatory comments with respect to PME MTL.

PME MTL reserves the right, in its sole discretion, for any reason, to disqualify any entry deemed inappropriate or in violation of the foregoing. Any content submitted to PME MTL will not be returned to you. By submitting your content to PME MTL as part of this Contest, you grant PME MTL a royalty-free, perpetual, non-exclusive, irrevocable, unrestricted, worldwide license to publish, reproduce and distribute your entry in all media, on all platforms and by any other means of communication controlled or authorized by them in connection with the Contest and PME MTL's promotions in connection with the Contest. You waive all moral rights in your entry when it is used for these purposes. You authorize PME MTL to use your name, likeness and voice, in their sole discretion, in connection with the use of your entry. The application of a collective agreement may be required. The list of winners and the winning entries may be posted on the PME MTL platforms for an indefinite period of time after the closing of the Contest.

2. ELIGIBILITY REQUIREMENTS

Entrants must reside in the Greater Montréal area and must be of legal age (18 years) on the Contest start date. The following persons are not eligible: (a) Employees of the PME MTL network during the Contest Period; (b) Employees of PME MTL network partners involved in the Contest and their respective affiliates; (c) Immediate family members of the above (father/mother, brother/sister, (including brother/sister-in-law, step-brother/sister-in-law), son/daughter) and persons living in the same household as them.

3. METHOD OF AWARDING PRIZES

A draw will be made after the closing of the Contest among all eligible entries received during the Contest Period. An eligible entry is an entrant who has (a) indicated a "gourmet" or "experiential" preference; (b) written a message of support and encouragement and picked their favorite company (if the company has a Facebook account); (c) commented on the publication of the Facebook page in connection with the Contest. One hundred and twenty (120) entrants who have chosen the Gourmet Box will be drawn at random and one hundred (100) entrants who have chosen the Experiential Box will also be drawn at random. The two-hundred forty (240) entrants designated by the drawing of lots shall be declared winners, subject to fulfilling all the conditions provided for in this rule. Each potential winner will be contacted directly by message on their Facebook account and will have to fill out the confirmation form including the mandatory information within forty-eight (48) hours from the date and time they were first contacted to claim their prize. In the event that a potential winner does not claim the prize within this time period (if applicable), declines the prize or is declared ineligible, the prize will be automatically forfeited and PME MTL may, at its sole discretion, designate an alternate potential winner, even if the potential winner's name has already been publicly announced. PME MTL may, at its sole discretion, require proof of identity or age of an entrant. The refusal to provide the requested evidence will automatically result in the disqualification of the entrant.

4. PRIZE DESCRIPTION

Each winner will win according to his or her choice:

  • One (1) Gourmet Box worth $37 (120 boxes to be won)
    • One (1) bar of Qantu chocolate
    • One (1) can of Kombucha from Club Kombucha
    • One (1) can of beer from 4Origines
    • One (1) bag of coffee from Café Barista
    • One (1) jar of crickets or darkling beetles from La Mexicoise
    • One (1) brownie from La Fabrique Essentielle

Any priority allergen as defined by Health Canada, sources of gluten and sulphites will be included in the list of ingredients of the Gourmet Box products.

  • One (1) Experiential Box worth $62 (100 boxes to be won)
    • One (1) pair of tickets for one of the following three (3) movie theatres: Le Beaubien, Le Cinéma Du Parc, Le Cinéma du Musée
    • One (1) general admission ticket for the Ecomuseum Zoo
    • One (1) chocolate initiation and tasting workshop with État de Choc
    • One (1) online yoga session with Human Movement
    • One (1) introductory session on circus methods at L’École de cirque de Verdun

The approximate total value of the Gourmand Box prize is: $37

The approximate total value of the Experiential Box prize is: $62

PME MTL will not be held responsible:

  • for any damage caused to an entrant or any third party in connection with the participation in the contest or the performance which is the subject of the experiential prize;
  • without limitation, for any postponement, cancellation, amendment or other change as to the date or time, place, duration, terms or nature of the service which is the subject of the experiential prize;
  • for any restriction or condition imposed by the Government or by the organizers of the service that is the subject of the experiential price.

5. GENERAL TERMS AND CONDITIONS

5.1. To be declared a winner, the entrant designated in a drawing of lots must meet all of the Contest’s terms and conditions (see 3. Method of Awarding Prizes).

5.2. By entering the Contest you: (a) acknowledge that you have read, accepted and abided by the Contest Rules; (b) confirm that you meet all Contest eligibility criteria and accept the prize and take part in it (if you win); (c) accept the prize offered by PME MTL as such; and (d) consent to the use of your name, city and province of residence, likeness, statements and/or voice, and your entry, without compensation, by PME MTL for promotional and other purposes in connection with the Contest; (e) and your heirs, successors and assigns release PME MTL and the PME MTL network partners involved in the Contest from any and all liability for any compensatory, direct, indirect, consequential or other damages that may arise from your entering the Contest, the use of your entry and the awarding, acceptance and use of the prize awarded (if you win).

5.3. The prize shall be accepted as such and shall not be exchanged, refunded, sold or transferred. No substitutions will be made. Any unused portion of a prize awarded, for any reason, will be cancelled. In the event that it is impossible to provide the prize exactly as it is described in these Rules, Contest Organizers reserve the right to substitute a prize or an item of approximately equivalent value, at their sole discretion. In no case will PME MTL be held liable for a greater number of prizes than indicated.

5.4. Refusal to accept the prize or part of the prize relieves the Contest Organizers from any obligation to the winner concerning the prize or part of the prize in question.

5.5. In the event of a dispute or complaint regarding whether an entry violates the Contest Rules, entries will be deemed to have been submitted in accordance with the Contest Rules by the authorized account holder of the account used to submit the entry in question. You may be required to provide proof (in a form acceptable to PME MTL) that you are the authorized account holder of the account used to submit the relevant entry and, where applicable, that you have all necessary consents, authorizations and/or licenses as required by the Contest Rules. If PME MTL determines (in its sole discretion) that an entry violates the Contest Rules, it will automatically be disqualified from the Contest.

5.6. The decisions of PME MTL with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, all decisions regarding the eligibility/disqualification of entrants and/or entries.

5.7. PME MTL reserves the right to amend the Contest Rules or to terminate the Contest at any time without any liability whatsoever to any entrant. Any changes to the Contest Rules will be posted on the Website. Without limiting the foregoing, PME MTL reserves the right to adjust, without prior notice, the dates and/or deadlines mentioned in these Contest Rules, when necessary, as a result of technical or other problems, or in the light of any other circumstances that, in the opinion of PME MTL, in its sole discretion, affect the proper administration of the Contest as contemplated in these Contest Rules, or for any other reason.

5.8. Contest Organizers disclaim all liability for loss, damage or injury of any kind, including but not limited to: i) lost, stolen, late, damaged, misdirected, destroyed, illegible or incomplete entries; ii) loss, theft or loss of integrity of software or computer or telephone data, including breaches of privacy; iii) fraudulent calls; iv) the inability of any person to enter the Contest for any reason whatsoever, including but not limited to, mailing or e-mail address errors, computer or telephone malfunctions or any other problems with the operation of online computer systems, servers, access providers, computer equipment or software; lost, late, incomplete, illegible or misdirected entries; bugs, service failures, hardware or software failures or losses, transmission delays or compromised transmissions; (v) any damage to any person's computer equipment, including damage resulting from the use or downloading of any content related to the Contest; vi) any delay or inability to act due to an event or situation beyond their control, including a strike, lockout or any other labour dispute at their place of business or at the places of business of the organizations or companies whose services are used to hold the Contest; (vii) loss, damage, breakage or misdirection of the prizes upon delivery; or (viii) loss, damage, defect or inability to use the prize once it has been awarded to the winner for any reason.

5.9. The social media or other platforms used for this Contest, as well as their respective parent companies, affiliates, directors, officers, agents, consultants, volunteers and employees disclaim all liability for any damages, compensatory, direct, indirect, consequential or other damages that may be caused by or in any way related to entering the Contest or downloading any information related to the Contest.

5.10. You agree that in your use of social media or other platforms for this Contest – including, without limitation, in chat areas and during registration and use of social media accounts, usernames or group names – you will not use language that is obscene, defamatory or offensive, that infringes upon the trademark or trade name of any third party, or that violates any other intellectual property or privacy rights.

5.11. If it is determined by PME MTL that individuals tamper with or misuse any aspect of the Contest, including, but not limited to, violating the Contest Rules, attempting to enter the Contest more than the maximum number of times allowed, or acting in a manner which interferes with the normal operation of the Contest, such individuals will be disqualified. Any person who enters or attempts to enter the Contest using robotic, automated, macro, programmed, or any other similar method, or through any third party, will have such attempts voided and that person will be disqualified at the sole and absolute discretion of PME MTL.

5.12. Where the Contest Rules allow entries via social media such as Instagram, Facebook, Twitter or any other social network, entrants are informed that PME MTL assumes no responsibility whatsoever in connection with the holding of the Contest. However, when entering via social media, all rules governing the use of social media apply.

5.13. PME MTL reserves the right to cancel or suspend the Contest at its sole discretion for any reason, including but not limited to, if a virus, bug or other factor beyond its control corrupts the security or proper administration of the Contest. Any attempt to intentionally cause damage to any website or to interfere with the lawful conduct of this Contest constitutes a violation of criminal and civil law. In such case, PME MTL reserves the right to seek redress through any legal means available to it, including a claim for damages, and even criminal prosecutions.

5.14. The personal information requested on the entry form, such as name, age (if applicable) and contact information, is collected, retained and used by PME MTL for the purposes of administering the Contest as well as for any other purposes to which you have consented at the time of entry.

5.15. In the event of a dispute as to the identity of an entrant, the authorized account holder of the Facebook account at the time the entry was submitted will be deemed to be the entrant. A winning entrant may have to provide proof that it is the authorized holder of the Facebook account associated with the entry. All entries must be submitted from a valid Facebook account. The time and date of publication on Facebook will be used to validate the entry.

5.16. The odds of winning depend on the number of eligible entries received. PME MTL reserves the right to disqualify all entries that are incomplete, illegible, damaged, irregular, submitted by illicit means, sent by automated or robotic sending methods that artificially increase the odds of winning or that do not strictly comply with the Contest Rules. PME MTL disclaims any responsibility for errors or omissions in the printing of material or advertising related to the Contest.

5.17. In the event of any discrepancy or inconsistency between these Contest Rules and the disclosures or other statements contained in any Contest-related materials, including but not limited to the Website and/or point of sale, television, print or online advertising, the English version of these Contest Rules and/or any instructions or interpretation of these Rules provided by any representative of PME MTL or PME MTL terms of use, the terms and conditions of the Contest Rules shall prevail to the fullest extent permitted by law.

5.18. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If a provision is found to be invalid, inapplicable or illegal, these Contest Rules remain in force and shall be interpreted in accordance with their terms and conditions as if such provision were not contained herein.

5.19. By entering the Contest, entrants agree to comply with these Contest Rules and with the decisions taken by PME MTL, which are final and enforceable.

5.20. Contest entry, as well as entrants’ consent to take part and comply with the Contest Rules, is governed by the laws of the Province of Québec and the federal laws of Canada applicable therein. By submitting their entry form, entrants agree to submit to the exclusive jurisdiction of the Québec courts.

5.21 PME MTL will not be held responsible:

- for any damage caused by an entrant or any third party in connection with the contest entry or the performance which is the subject of the experiential prize;

- without limitation, for any postponement, cancellation, amendment or other change as to the date or time, place, duration, terms or nature of the service which is the subject of the experiential prize;
